This page states the terms and conditions on which WIFDC sells any of the products listed on our website www.wheres-it-from.com.

Please keep a copy of this for your records and for future references when making purchases with us.

 

Any purchase made with us means that you have accepted our terms and conditions regardless of whether you are a site member. If you are not happy to accept these terms and conditions then do not use our website.

2. Service Availability

We ship to England, Scotland, Wales and Ireland (including republic). We do not ship worldwide. More details can be found on our shipping and delivery page.

 

3. How the contract is formed between you and us

After you have placed an order on our website you will be given an order number which indicates to you that we have received your order; this does not mean your order has been accepted. Your order is an offer to us it will only be accepted provided we have the stock available. We will then send you a ‘shipping confirmation’ email, this means your order has been accepted by us and we have the items you have ordered available and ready to dispatch. Payment must be received at the time of placing the order otherwise the goods will not be dispatched from us.

If you have made a mistake with your order it is possible to change it providing, we haven’t dispatched the goods yet. If this should be done as urgently as possible to avoid you receiving items you don’t want. If you request to change your order after we have shipped the item it is your responsibility to return the item to us for it to be exchanged providing we have the new item instock. We have the right to cancel an order if full payment isn’t made at the time of order or items are out of stock at the time of order.

When placing an order with us you must understand that you must abide by this contract. You are also acknowledging that all information you have provided such as your name and address are accurate. If your address is not provided fully, we have a right to cancel your order without warning as it will not be accepted by our shipping provider. It is not our responsibility to contact you for your full address. If you have imputed information wrong or information has changed since the time of your order it is your responsibility to contact us with the correct information to allow us to process your order further.

 

  4.Consumer rights 

If you Are contracting as a consumer, you may cancel a contract at any time within 7 days, beginning on the day after you receive the products. If you are an EEA user, as per the agreement, you must cancel a contract any time within 14 days. In this case, you will have the right to exchange an item with us for the full price paid for the products. Any additional money will be given as store credit in accordance with our returns policy.

 

5. Availability and delivery

Your order will be fulfilled by the delivery date set out in the shipping confirmation email, unless there are exceptional circumstances.

 

6. Price and payment

The price payable for the items ordered will be stated on the website clearly. Prices on the website include UK VAT but exclude delivery charges.

Delivery charges will be shown separately and may vary depending on speed of delivery. Payment should be made by the consumer by the means stated on the website and shall not be deemed to be made until we have received cleared funds in respect of the full amount stated in the order. Prices may change but it will not affect the price of orders already accepted by us.

Payment for all products must be by credit or debit card. We accept payment with Visa, Visa debit, Mastercard and American Express. We also accept payments via paypal.

Only one promotion code can be used per order.

8. Our Liability

If we do not deliver or if the products we deliver are not what you ordered or are damaged or defective or the delivery is of the incorrect quantity, our only obligation will be, at our option to:

Replace or repair any products that are damaged or defective providing we have clear evidence from you of the damage to the item and is clear it is either the fault of us or the shipping provider. If the item has been damaged by the consumer by error, we are not liable to replace your item.

If an item fails to be delivered or we are un able to provide you an item from your order we will offer you a full return for the item in question.

If the shipping provider has made attempts to deliver to your address and is unable to; you the consumer is liable to contact the courier for redelivery or to change delivery preferences. If an item is lost in the post we are not liable for this. It is your responsibility to claim back the money from the shipping provider for your purchase. We provide tracking information on every order we send out and therefore we give you the choice to track your order and made changes.

We shall not have liability to you for a consequential, special or indirect loss including without limit loss of revenues, profits, contracts, business or anticipated savings damage to or loss of goodwill, reputation or data.

Without prejudice to the foregoing, our total aggregate liability to you under and/ or arising in relation to this contract shall not exceed the amount paid by you for the products.

Nothing in this contract shall exclude or limit our liability for death or personal injury due to our negligence or an liability which is due to our fraud or and liability which we are not permitted to exclude or limit as a matter of law. Nothing in this contract shall exclude or limit your statutory rights. A person who is not a party to this contract has no right under the contracts (Right of third parties) Act 1999 to enforce any term of the contract.

 

9. Intellectual property rights

All and any intellectual property rights in connection with the products shall be owned by us absolutely.

 

10. Indemnity

You agree to indemnity, defend and hold harmless WIFDC, its owners and all third party claims, liability, damages and or costs arising from, without limitation, your breach of these terms and conditions, your infringement of any intellectual property right or any other right of any personal or entity, or you breach of any duty of confidence or privacy or any defamatory statements made by you in any form.

 

11. Written communications

Laws require that information and communications we send to you should be in writing. When using the site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. By contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communication is writing. This condition does not affect your statutory rights.

All notices can either be given to us through email at: wifdc@hotmail.com or Instagram wifdc_. We will always contact you electronically through the given email addresses etc given to us at the time you place the order.

14. Transfer of rights and obligations

The contract between you and us is binding between us and our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of a contract or any of your rights or obligations arising under it, without our prior written consent.

We are allowed to transfer, assign, charge, sub-contract or otherwise dispose of a contract or any of our rights or obligations arising under it, at any time during the term of the contract.

15. Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations under the contract that is caused by events outside our reasonable control (Force Majeure Event) This includes strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters. impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. Impossibility of the use of public or private telecommunications networks. The acts, decrees, legislation, regulations or restrictions of any governemnt.

Our performance under any contract is deemed to be suspended for the period that the force Majerure event continues and we will have an extension of time for performance for the duration of that period.

17.Discount code terms and conditions

Official WIFDC discount codes entitle you to and extra percentage (specific to the discount code in question) off your next order online from www.wheres-it-from.com. To claim your discount when in the 'shopping bag' section of your account there is an option to 'enter a promo code' which allows you to enter the promotional code in order to apply it to ypur order.

There is no cash alternative.
